About this deal

Certainly this lady got healing from it and it’s another alternative just to prosecutions,” he said. When you took the oath or affirmation to return a verdict according to the evidence you did so together as a jury. As a result you have a collective responsibility to ensure that that your decisions are made solely on the basis of the evidence. Accordingly, if you become aware that a fellow juror has been carrying out any research outside the evidence, for example, on the internet, the rest of you must report that to the clerk of court as soon as possible. I am sure that it will not need to come to that because I am confident that having giving you these directions, each of you will act responsibly and comply with them." Cuyler [married name Rice], Margaret (1758–1814), actress and courtesan". Oxford Dictionary of National Biography (onlineed.). Oxford University Press. 2004. doi: 10.1093/ref:odnb/64329 . Retrieved 28 November 2020. (Subscription or UK public library membership required.) He added that should he have any information that would assist ICRIR investigators he would make them aware of it. Det Sgt Stuart Harkness told the High Court in Glasgow her persistent silence and focus on a set of rosary beads was a technique used by terrorists.

Our thoughts are very much with her family, friends and all of those affected at this difficult time. The first question is whether there has been prejudicial publicity. If there has been, the question arises as to whether the risk of prejudice can be removed by: the passage of time between the publication of the material and the trial; the focusing effect of listening to evidence over a prolonged period; and the likely effect of the directions by the trial judge. He added that even though as “a lot of police officers” were prosecuted and dealt with by “internal investigation” he understands that “from a perception point of view, people didn’t see it”. At the end of the first week of the trial, and from time to time, on more or less a weekly basis, I said something along the following lines:We look forward to working alongside others in the promotion of the positive & urgent case for Scottish independence. He said that under parity of esteem principles embodied in the Good Friday Agreement he embraced Martin McGuinness as education minister and later Deputy First Minister “because I believed that if we were going to move this place on that was the right and proper thing to do”. You should not discuss the evidence with other people outwith your own number, including family and friends; David, Saul. Prince of Pleasure: The Prince of Wales and the Making of the Regency. Grove Press, 2000. There was no dispute as to the applicable law. The test was that set out in Stuurman v HM Advocate 1980 JC 111, which had been approved for the purposes of article 6 (1) in Montgomery v HM Advocate 2001 SC (PC) 1. The test in Stuurman was:

Alice Sheridan, 84, died following the fire which took place at Invergyle Drivein Cardonald, Glasgow, at about 7.55pm on Sunday evening. He went on: "Was it because she was a practising Catholic and acting on the advice of her QC that you accused her of acting like a Provisional IRA terrorist?" This Note is in two parts. In the first part I set out my reasons for repelling pleas in bar of trial based on prejudicial pre-trial publicity and related devolution minutes. In the second part I record the directions which I gave to the jury at various stages in the trial with respect to publicity. In December 1815 Sheridan became ill and was largely confined to bed. He died in poverty. However, dukes, earls, lords, viscounts, the Lord Mayor of London, and other notables attended his funeral, and he was buried in the Poets' Corner of Westminster Abbey. The other allegation dropped was that she lied when she said she saw Katrine Trolle at the Scottish Socialist Party Conference in Perth in 2005. Mr Sheridan pointed to previous instances when paramilitary groups have co-operated with investigations. The detective was also part of the police interview team which questioned Mrs Sheridan for five hours in February 2008. The fire was extinguished by the Scottish Fire and Rescue Service and inquiries into the circumstances are ongoing.” Sheridan, Richard Brinsley. "At the Trial of Warren Hastings", The World’s Famous Orations, Ireland, 1906

I accept that there has been prejudicial publicity in this case. The first two articles in the News of the World made allegations about Mr Sheridan's private life. In the third article his reasons for resigning were challenged as being untrue, his credibility was challenged in relation to what he might say in an action for defamation. After the initial allegations in the News of the World stories many articles were published in other newspapers in relation to the allegations and Mr Sheridan's resignation. The trial itself was the subject of intense media coverage. Subsequent articles have alleged that Mr Sheridan lied in his evidence at the civil trial; that he lied in relation to the reasons for his resignation as convener of the SSP; and that he lied when he denied being the person speaking on the videotape. Allegations have been made in press articles about interference with witnesses and potential witnesses. Reference has been made to evidence which does not exist and to evidence that could not be used in a criminal trial. Reference has been made to an allegation that Mrs Sheridan stole from her employers. Mr Sheridan agreed that while heading up the PSNI’s Crime Operations Department he encountered sensitive and secret information. As the prosecution's case against Gail Sheridan got under way, Mr Sheridan, who is conducting his own defence, asked Det Sgt Harkness, 38, whether he had "harassed and intimidated" the former politician's wife. On 31 October 2004 the News of the World published an account by Anvar Khan of sexual activity in which she had engaged with an unnamed member of the Scottish Parliament (MSP). The activities included sexual intercourse with her, group sex with her and others, and a visit to a swingers club in Manchester. Operations Control mobilised four fire appliances and one aerial appliance to the scene, where firefighters extinguished a fire affecting a multi-storey flat. And we will be saying, and I know Sir Declan is the same, the state will have a responsibility to provide the information we ask for.”
